1. Introduction
Eightball, Inc. (“Eightball,” “we,” “us,” or “our”) operates an AI-powered study platform available at eightball.ai and related domains. This Privacy Policy explains how we collect, use, disclose, store, and protect information when you access or use the Service.
By creating an account or using the Service, you acknowledge this Privacy Policy and confirm that you are at least eighteen (18) years old, as required by our Terms of Service.
2. Information We Collect
We collect information you provide directly, including account details, university or course information, uploaded academic materials, prompts and queries, support communications, referral data, and payment or billing information processed by Stripe.
We also collect information automatically, including device and browser details, usage data, log data, analytics data, cookies, local storage, and similar technologies. We may receive information from authentication providers, payment processors, referral programs, promotional campaigns, and partners.
3. How We Use Your Information
We use information to provide and operate the Service, process User Content through AI systems, generate study aids, store materials, manage accounts, authenticate users, process billing, send service communications, provide support, improve the product, detect abuse, protect security, and comply with legal obligations.
We do NOT sell personal information, use personal information for third-party targeted advertising, train AI models on uploaded academic content, build advertising profiles from academic activity, share data with data brokers, or use content for purposes outside delivering and improving the Service as described here.
4. AI-Generated Content and Your Data
When you upload lectures, notes, documents, recordings, or other materials, our AI systems process that content only to deliver study aids such as transcripts, summaries, flashcards, practice tests, and chat responses.
Third-party AI providers may process content securely to generate outputs. Where available, we contractually prohibit those providers from using your content to train their models, and we do not send directly identifying account details alongside academic content. AI outputs may contain inaccuracies; see our Terms of Service for related disclaimers.
6. Data Retention and Deletion
We retain personal information and User Content while your account is active or as reasonably needed to provide the Service. You may request deletion of your account and associated personal data by emailing privacy@eightball.ai or through account settings.
After a verified deletion request, we delete or irreversibly anonymize personal information within thirty (30) days unless retention is required by law or legitimate business purposes. Backups may retain deleted data for up to ninety (90) days; anonymized and aggregated data may be retained indefinitely.
7. Data Security
We use commercially reasonable technical, administrative, and organizational safeguards, including encryption in transit and at rest, access controls, security assessments, secure authentication, monitoring, and incident response procedures.
No electronic transmission or storage method is completely secure. You are responsible for keeping account credentials confidential and should contact support@eightball.ai if you believe your account was compromised.
9. Your Rights and Choices
All users may access, correct, update, copy, or delete personal information, opt out of promotional communications, and withdraw consent for optional processing where applicable.
California residents may have CCPA/CPRA rights to know, delete, correct, opt out of sale or sharing, and avoid discrimination. EEA and UK users may have GDPR rights, including access, rectification, erasure, restriction, portability, objection, and complaint rights. Turkey users may have KVKK rights. Contact privacy@eightball.ai to exercise applicable rights.
10. Children's Privacy and Age Requirement
The Service is designed for college and university students and intended only for users at least eighteen (18) years old. We do not knowingly collect personal information from anyone under 18.
If we learn that a person under 18 provided personal information, we will take steps to delete it and terminate the associated account. Parents or guardians may contact privacy@eightball.ai.
11. International Data Transfers
Information may be transferred to, stored in, and processed in the United States and other countries where our providers and infrastructure are located. These jurisdictions may have different data protection laws.
By using the Service, you consent to those transfers. For users in the EEA, UK, or Turkey, we rely on appropriate transfer mechanisms such as Standard Contractual Clauses where required.
12. Do Not Track Signals
Some browsers send “Do Not Track” signals. Because there is no universal standard for responding to those signals, the Service does not currently respond to them. We do not track users across third-party websites.
13. Third-Party Links and Services
The Service may link to third-party websites, services, or applications that Eightball does not operate or control. This Privacy Policy does not apply to those services, and we are not responsible for their privacy practices, content, or security.
14. Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes in our practices, technology, legal requirements, or operations. We will post the updated policy with a revised “Last Updated” date and may send email notice when required or when changes are material.
Continued use after changes take effect means you accept the revised policy. If you disagree, stop using the Service and request account deletion.
